This End-User License Agreement ("Agreement") is a legal agreement between you (either an individual or a single entity, referred to herein as "you" or "your") and Countrywide Process, LLC ("Company," "we," "us," or "our") for the use of the Countrywide Process app platform ("Platform"). This Agreement covers all services provided through the Platform, including but not limited to eFiling, Physical Court Filing, eService, County Recording, eRecording, Process Service, Skip Tracing, Case Research, and Document Retrieval (collectively, "Services").
By downloading, installing, accessing, or using the Platform, you agree to be bound by the terms of this Agreement. If you do not agree to the terms of this Agreement, do not download, install, access, or use the Platform.
Subject to the terms of this Agreement, the Company grants you a non-exclusive, non-transferable, limited license to use the Platform and Services for conducting business in accordance with this Agreement.
You shall not:
- Modify, distribute, sublicense, lease, rent, loan, or create derivative works based on the Platform or Services.
- Use the Platform or Services for any unlawful purpose or in any manner inconsistent with this Agreement.
- Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code for the Platform.
You agree to:
- Provide accurate, current, and complete information as may be prompted by any registration forms on the Platform.
- Maintain the security of your password and identification.
- Accept all risks of unauthorized access to the registration data and any other information you provide to the Company.
The Platform and all intellectual property rights therein are owned by the Company or its licensors. The content, arrangement, and layout of the Platform, including but not limited to, the trademarks, service marks, logos, and all other materials provided by the Company are the property of the Company or its licensors and are protected by copyright, trademark, patent, and other intellectual property laws.
This Agreement is effective until terminated by either you or the Company. Your rights under this Agreement will terminate automatically without notice from the Company if you fail to comply with any term(s) of this Agreement.
The Platform and Services are provided "AS IS" without warranty of any kind, express or implied. The Company expressly disclaims all warranties, including, but not limited to, the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
In no event shall the Company be liable for any direct, indirect, incidental, special, exemplary, or consequential damages (including, but not limited to, procurement of substitute goods or services; loss of use, data, or profits; or business interruption) arising in any way out of the use of the Platform or Services, even if advised of the possibility of such damage.
This Agreement constitutes the entire agreement between you and the Company and governs your use of the Platform, superseding any prior agreements between you and the Company. This Agreement and the relationship between you and the Company shall be governed by the laws of the jurisdiction where the Company is established, without regard to its conflict of law provisions.
BY DOWNLOADING, INSTALLING, ACCESSING, OR USING THE PLATFORM, YOU ACKNOWLEDGE THAT YOU HAVE READ THIS AGREEMENT, UNDERSTAND IT, AND AGREE TO BE BOUND BY ITS TERMS AND CONDITIONS.
